On May 20, 2014, the taxi-taking software didi taxi-taking showed that it was formally renamed as “didi”. Cheng Wei, CEO of Xiaoju Science & Technology showed that this name even more met customer habits. But is this really all the reason for this?
Meeting customer habit perhaps is really not all the reason. Because Hangzhou Miaoying Microelectronics Co., Ltd. declared days ago that it has lodged an action against Beijing Xiaoju Science & Technology for infringement, requiring Xiaoju Science & Technology to stop using that trademark and indemnify RMB 80 million yuan. At present, the case has been accepted by Hangzhou Intermediate People’s Court to open a court session on a selected day.
It is known that Miaoying registered “didi” and “Didi” trademark two years ago, which falls in category 9 (such types as computer program, software that can be downloaded, etc.). The principal of that company said that the core products of the company including the taxi-taking software succeeded in registering “didi” trademark on May 21, 2012. But the registration application made by Beijing Xiaoju Science & Technology Co., Ltd. was half year later. After use, it constituted trademark infringement.
Li Changxu, attorney for didi taxi-taking said that didi taxi-taking used “didi” and “taxi-taking” and graphics in a composite manner, which constituted no infringement on the “didi” trademark held by Miaoying. On mentioning this case, Cheng Wei, CEO of didi taxi-taking showed that the legal registration of “didi taxi-taking” trademark was under way of review and it was not sure for the time being. As to whether it has constituted an infringement on “didi”, judicial procedure has been entered into and there is no comment now.
When mentioning subsequent development, Cheng Wei said that we had engaged in lawsuit with Miaoying for nearly two years. The possibility to get it back is high. But the lost time waits for no man. It is proper to rename.
It is known that in Mar. 2013, Xiaoju Science & Technology where didi taxi-taking is in submitted an application for “didi taxi-taking” graphic, text combination trademark to State Administration for Industry & Commerce. In Apr. 2014, “didi taxi-taking” graphic, text combination trademark has passed initial examination of the Trademark Bureau of State Administration for Industry & Commerce with an announcement made. After passing the initial examination to that trademark, Xiaoju Science & Technology has initiated brand renaming preparation procedure and renamed formally.
